By downloading, installing, or using the PoPcA application ("the App"), operated by Mercaly, you agree to be bound by these Terms of Service ("ToS"). If you do not accept these terms, you must not use the App.
PoPcA is a mobile social network that allows users to:
• Create and share content (posts, photos, videos)
• Interact with other users (likes, comments, shares, DMs)
• Broadcast live streams with chat and virtual gifts
• Monetize content (ads, gifts, shop)
• Participate in creator battles
• Buy and sell in an integrated marketplace
Minimum age: 13 years old.
13-17 years old: parental consent required, restricted features (no monetization, no adult content).
18+ years old: full access.
One account per person. Accounts must contain accurate information. You are responsible for the security of your password. Enabling two-factor authentication (2FA) is strongly recommended.
The following is strictly prohibited and will be removed and/or reported to authorities:
• Any sexual content involving a minor (CSAM)
• Hate speech, racism, sexism, homophobia, discrimination
• Threats, harassment, cyberbullying
• Glorification of terrorism, violence, or suicide
• Doxxing (publishing others' personal information)
• Content violating copyright, trademark, or intellectual property
• Spam, phishing, scams, Ponzi schemes
• Promotion of illegal drugs, weapons, criminal activity
• Non-consensual deepfakes or misleading manipulated content
• Pornographic content outside age-verified, dedicated spaces
• AI moderation: all content is automatically analyzed by our AI before publication. Inappropriate content is blocked or removed without notice.
• User reporting: any user can report content. Reporting abuse is sanctioned.
• Human review: complex cases are reviewed by our moderation team.
• Possible sanctions: warning, temporary restriction, suspension, permanent ban, reporting to authorities.
• Your content: you retain all rights to the content you post. By posting, you grant Mercaly a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, adapt, and distribute this content for the operation and promotion of the App.
• Our content: the name "PoPcA", logos, interface, code, design, and algorithms are the exclusive property of Mercaly. Any unauthorized reproduction is prohibited.
• Virtual coins: purchasable via credit card (Stripe) or PayPal. Non-refundable except where legally required. No monetary value outside the App.
• Advertising: creators can purchase targeted ads. Minimum budget is $1 per campaign. Billed cost-per-view (CPV) or cost-per-mille (CPM).
• Creator earnings: hosts of sponsored content receive per-view remuneration. Mercaly charges a 20% commission on transactions. Minimum payout threshold is $10.
• Taxes: creators are responsible for their tax obligations in their country of residence.
The text content of your posts is end-to-end encrypted (E2E) using the Fernet algorithm (AES-128). See our Privacy Policy for more details on data processing.
• The App is provided "as is". We do not guarantee uninterrupted or error-free operation.
• Mercaly is not liable for content posted by users.
• Our liability is limited, to the maximum extent permitted by law, to the amount you paid to Mercaly in the last 12 months.
• We are not liable for indirect damages, loss of profits, data loss, or business interruption.
By you: you can delete your account anytime from settings. Your data will be deleted within 30 days.
By us: we may suspend or delete your account without notice in case of:
• Breach of ToS or law
• Behavior threatening community safety
• Fraudulent or abusive use
• Prolonged inactivity (> 24 months)
Coin balances and earnings may be forfeited in case of suspension for serious breach.
We may update the ToS. Significant changes will be notified to you in the App or by email at least 30 days before they take effect. Continued use after modification constitutes acceptance.
These ToS are governed by Haitian law and, subsidiarily, by French law for users residing in the European Union.
Amicable resolution: any dispute shall first be subject to an amicable resolution attempt. Contact us at legal.popca@mercaly.com.
Jurisdiction: failing amicable agreement, the courts of Port-au-Prince (Haiti) shall have exclusive jurisdiction, subject to mandatory consumer law provisions to the contrary.
